These Terms are an agreement between you and the independent developer behind Pulse Tracker, contact support@pulsetracker.pro ("we"). They cover the Pulse Tracker Android app, this website and everything the account does — together, "the service". By installing the app, creating an account or using the site you accept them. If you do not accept them, do not use the service. They apply to everyone using the service today.
Pulse Tracker reads heart rate and related data from a fitness band over Bluetooth and shows it on your device. Optional features: recorded sessions with a per-zone breakdown and CSV export, a heart-rate overlay for video, and shared rooms where the participants see each other's live pulse. The service is free of charge; there is nothing to buy inside it.
Rooms need an account. Give accurate details when you register, keep your password to yourself, and remember that what happens under your account is your responsibility. You can see every device signed in on your profile screen and end any of them. You must be old enough to enter into a binding agreement where you live — and in any case at least 16 in the European Economic Area, or 13 where national law allows it.
In a room, your live and recorded heart rate, your username and your display name are visible to everyone else in that room. Your email address is not. Join rooms you trust and share room codes as carefully as you would share anything else about your body. Do not use a room to collect other people's readings without their knowledge, and do not join one on someone else's behalf.
You can leave at any time; a room disappears, with everything recorded in it, shortly after its last participant leaves.
Do not use the service unlawfully; do not attempt to break into it, overload it, or reach data that is not yours; do not automate abuse of it; and do not interfere with anyone else's use. We may limit how often certain requests are accepted, and we may suspend an account that breaks these rules.
Your readings are yours. You grant us only the narrow permission needed to run the features you actually use — relaying your pulse to the room you joined and storing that room's session so its participants can review it. Nothing is sold, and nothing is used for advertising. What we process and for how long is set out in the Privacy Policy, which forms part of these Terms. You can delete your account, in the app or on the site, at any time.
The service is provided "as is" and "as available". It is a small independent project: features may change, and the service may be unavailable, interrupted or discontinued. We will not delete your account without cause, and if the service is shut down for good we will say so on this site with reasonable notice so you can export what matters to you.
Physical activity carries risk, and heart-rate figures on a screen do not change that. By using Pulse Tracker you confirm that:
To the fullest extent permitted by law, the service is provided without warranty of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that readings are accurate or complete, that the service will be uninterrupted, secure or error-free, that recorded data will be preserved, or that any defect will be corrected.
To the fullest extent permitted by law, and regardless of the legal theory relied on, we are not liable for:
The service is free of charge, so to the extent the law permits a cap, our total aggregate liability to you for all claims is limited to the amount you have paid for it, which is nil.
A room shows your pulse to the people in it because that is what you asked it to do. We do not control who they are or what they do with what they see: choose whom you share a room code with, and leave the room when you are done. We are not responsible for the conduct of other participants, nor for readings you deliberately export, publish or burn into a video.
If a claim is brought against us because of the way you used the service — breaking these Terms, breaking the law, or collecting other people's data without their consent — you agree to cover the reasonable costs and damages that result, so far as the law allows and to the extent the claim is attributable to your use.
We may update these Terms. When a change is material, the app and the site ask you to accept them again and do not continue until you do. If you would rather not accept, stop using the service and delete your account.
You may stop using the service and delete your account at any moment, with no explanation. We may suspend or end access for a breach of these Terms, and will tell you why where we can.
